1. Introduction

Welcome to Fallentimber Meadery's website (fallentimbermeadery.ca). These terms of service (the "Terms") govern your access to and use of the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with these Terms, you may not access or use the Site.

2. Use of the Site

2.1. Eligibility: You must be at least 18 years old to access or use the Site.

2.2. Account: Some features of the Site may require you to create an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account.

3. Intellectual Property

The Site and its original content, features, and functionality are owned by Fallentimber Meadery and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

4. User Content

4.1. By submitting or posting any content on the Site, including but not limited to reviews, comments, and messages, you grant Fallentimber Meadery a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

4.2. You represent and warrant that you own or have the necessary rights, licenses, consents, and permissions to grant the foregoing licenses to Fallentimber Meadery.

4.3. Fallentimber Meadery reserves the right to remove any user content from the Site for any reason without notice.

5. Limitation of Liability

In no event shall Fallentimber Meadery, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site; (ii) any conduct or content of any third party on the Site; (iii) any content obtained from the Site; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

6. Indemnification

You agree to indemnify and hold Fallentimber Meadery, its directors, employees, partners, agents, suppliers, and affiliates, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference or your violation of any law or the rights of a third party.

7. Changes to the Terms

Fallentimber Meadery reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Alberta, Canada, without regard to its conflict of law provisions.
